Breaking: El-Rufai Asks Court to Dismiss DSS Charge, Demands N2bn Damages

Former Governor of Kaduna State, Nasir El-Rufai, has approached the Federal High Court in Abuja seeking the dismissal of a criminal charge instituted against him by the Department of State Services (DSS).


In a motion on notice dated February 17, 2026, the former governor asked the court to quash the three-count charge marked FHC/ABJ/CR/99/2026, arguing that it discloses no offence known to law and fails to establish a prima facie case against him.


El-Rufai is specifically urging the court to strike out the charge in its entirety and discharge him, maintaining that the allegations contained in the suit are legally untenable.


In addition to seeking the dismissal of the case, the former governor is demanding N2 billion in damages against the DSS.

He described the action filed by the security agency as an abuse and misuse of court process, insisting that it has caused reputational harm and unnecessary legal burden.


The matter is expected to come up for hearing at the Federal High Court in Abuja, where the court will determine the merit of the application.
