Montreal Convention Now Binding on Nigerian Airlines….NCAA

The Nigeria Civil Aviation Authority (NCAA) has reaffirmed that all airlines operating within the country must comply fully with the provisions of the Civil Aviation Act (CAA) 2022, which domesticated the Montreal Convention of 1999.

The Montreal Convention was established to modernize and unify international air travel regulations, particularly in areas concerning airline liability for passenger injury or death, baggage and cargo loss or damage, and flight delays.

By virtue of the CAA 2022, its provisions are now binding on all carriers operating in Nigeria.

The Authority expressed concern that some domestic operators still rely on the outdated Warsaw Convention or calculate compensation based on baggage weight when resolving passenger claims.

It emphasized that such practices are inconsistent with the current legal framework and will no longer be tolerated.

According to the NCAA, the Civil Aviation Act 2022 and the Nigeria Civil Aviation Regulations (Nig. CARs) 2023 remain the supreme instruments guiding the industry, and any operator found violating them will face heavy sanctions.

The regulatory body reiterated its commitment to protecting passengers’ rights and ensuring that airlines uphold international standards in all aspects of their operations.
